A Lewiston man convicted of attempting to strangle his ex-girlfriend has been sentenced to serve a minimum of seven years in state prison, with a maximum of 15 years.
Joseph A. Witherup, 46, was sentenced June 26 by District Court Judge Mark Monson following a jury conviction on the attempted strangulation charge. Lewiston Police arrested Witherup in September 2025, shortly after the assault at the victim’s apartment.
Attack and Arrest
The incident involved Witherup punching and strangling the woman multiple times during the assault. He fled the scene but was apprehended a few blocks away.
Deputy Prosecutor Kali Jo Parker had requested a sentence ranging from 10 to 15 years, citing Witherup’s history of violent criminal offenses and the severity of the attack. Parker told the court that “despite the defendant’s best efforts to create one, there are no justifications for choking [the victim].” She noted that Witherup had shown no accountability or remorse for his actions.
Judge Monson’s sentence fell below the prosecution’s request but acknowledged the defendant’s history and assessed that he poses a significant risk to future romantic partners.
Prosecution and Case Details
The case was handled by the Nez Perce County Prosecutor’s Office. Prosecutor Justin Coleman praised the work of both Lewiston Police detectives and Parker in securing the conviction and sentence, saying law enforcement’s “hard work and dedication” was instrumental in bringing the case to resolution.
The conviction reflects the severity with which Idaho courts treat domestic violence and assault crimes. Attempted strangulation is considered a particularly dangerous offense, as it demonstrates intent to cause serious bodily harm or death.
Witherup’s background as a repeat violent offender played a significant role in the sentencing decision. Court records indicated his prior criminal history included multiple violent incidents, establishing a pattern of aggression that influenced the judge’s determination of the appropriate sentence length.
What Comes Next
Witherup is now in custody and will begin serving his sentence at an Idaho Department of Correction facility. With a minimum sentence of seven years, he will be eligible for parole consideration after that time, though the final determination will depend on his behavior while incarcerated and other factors considered by the state parole board.
The case underscores ongoing law enforcement efforts in Nez Perce County to address violent crime and domestic assault. Lewiston Police Department continues to investigate similar incidents and work with prosecutors to hold offenders accountable.
